Silicon Valley is going remote. 

What does this mean for legal professionals? 

Till 2020, if you wanted to drastically increase your chance of becoming really really rich in a relatively short amount of time, you had to land up in Silicon Valley.

Startups in the Silicon Valley got a different valuation compared to startups based out of any other place.

And most of the investment firepower was concentrated in Silicon Valley too.

Before the pandemic, only 3.6% of employees of US corporations worked from home. Now, it is at least 30%. It is a tectonic shift.

Mark Zuckerberg announced that he expects up to half of Facebook’s 48,000 employees to be working remotely within the next 10 years.

Other major companies embracing the work-from-home model include Shopify, Upwork and Coinbase, which are shifting toward “digital by default” and “remote-first” structures.

Remote.com surveyed 1,528 respondents in IT divisions of small and medium-sized businesses in the U.S. and the U.K.

Respondents in both regions believed more than a third of roles will be located overseas within five years, with U.S. respondents estimating 40%.

Amongst employees, 81% of respondents indicated that they would move if they could do so without affecting their work prospects. 

Employers who make it easy for employees to work remotely enjoy a much wider talent pool.

Data is not the new oil, affordable talent is. And it is easier to find affordable talent when you’re not restricted to a particular area. The world is slowly discovering this outside of tech. And this is happening in everything - design, management, marketing, sales, and of course, in law.

I am saying that as a law student,  law graduate or an aspiring legal professional you can jump into the remote version of Silicon Valley that exists on the internet today. You can become a part of the next big tech company. 

Why just Silicon Valley, you could work for startups in London, Berlin, Dubai, Shanghai, Tokyo, Kuala Lumpur or Tel Aviv.

Of all the work that you could do as a legal professional, contract drafting is something which is most amenable to being carried out remotely. You don’t need to be present before a court, you don’t need to file forms, and you do not need to be a qualified lawyer in that region, in order to draft contracts for clients.   • Leonard and Howard are partners in a Limited Liability Partnership based in Pasadena, California. Sheldon Cooper is a stakeholder in an LLC based in San Francisco, California. Leonard and Howard have approached Sheldon for investment into their partnership. Sheldon does not want to become a partner in the LLP. However, he is willing to invest in the LLP by providing a loan. He wants to include a clause on profit participation, in the event that the LLP defaults in paying the interest or repayment.   • The owner of a small but popular Thai Food joint based in San Diego, California is looking to put up a website with a menu and enable people to order from its website. Draft a privacy policy for its website.
  • Jimmy Ross, a Sole proprietor used to run a marketing consultancy business of his own. The business grew and he then started taking assignments in an LLC created by him. However, there were a few retainership clients with his sole proprietorship whom Jimmy is now looking to move to the LLC. Draft a Novation / Amendment Agreement.
  • An Italian restaurant in Buffalo, New York is looking to hire a food delivery services provider to deliver their orders. Draft a services agreement under 2 circumstances: i) Order is placed on the app of the restaurant, ii) food delivery services provider maintains an app to onboard and list various restaurants on it  
  • An equity research company researches investments in US companies in depth. They have employed a few researchers who require to share the information with each other for drafting and compiling reports. However, it wishes to ensure that the employees do not leak their research to external people. Draft a Non-disclosure Agreement to be signed by the employees of the company for such purpose. 
  • A software has been invented by a software company which allows medical professionals to share anonymized patient records with other professionals so that they can fill any gaps which may be preventing the best possible treatment of the patients and which uses artificial intelligence to analyze all available patient data to provide a probable diagnosis. A healthcare solution company wants to use the said technology in their system hardware and thus have approached the software company for the same.   • Two engineering students working on augmented reality now want to commence business by creating a Limited Liability Company and introducing an investor as a stakeholder. The investor is looking for affirmative voting rights on any new investment beyond USD1000, any new allotment of shares and any borrowing beyond USD 5000, since the business is high risk.
