Candidates need a master&#8217;s in science or an engineering degree in one of 14 listed disciplines, and must be 21 to 35 years old. Pay starts at Level 10 of the pay matrix, a basic of Rs 56,100 a month. It was advertised in July 2023, handed to the National Testing Agency (NTA) in December 2023 after the first prelim was cancelled, and closed with 550 candidates recommended and 407 examiners joining induction training in January 2025, according to the <a href=\"https:\/\/ipindia.gov.in\/storage\/uploads\/media\/English_Annual_Report_2024-25.pdf\" target=\"_blank\" rel=\"noopener\">IP India Annual Report 2024-25<\/a>. That&#8217;s about 18 months from advertisement to joining. No notification for 2025, 2026 or 2027 appears on ipindia.gov.in or nta.ac.in as of 24 September 2026, and under the 2018 rules the next one can be run by whichever agency the central government approves.<\/p>\n<p>&#8220;Patent officer&#8221; is the same job under its everyday name. The confusion comes from a different CGPDTM post. The Union Public Service Commission&#8217;s Advertisement No. 14\/2025, announced by the Press Information Bureau (PIB) on 5 December 2025 with applications open from 13 December 2025 to 1 January 2026, advertised 100 posts of Examiner of Trade Marks and Geographical Indications. That post sits at Level 7, needs a law degree and two years&#8217; experience and caps general-category age at 30, so listings that call it patent examiner recruitment 2026 are describing a different job.<\/p>\n\n<a id=\"h2-1\"><\/a><\/p>\n<h2 id=\"patent-examiner-eligibility\">Patent examiner eligibility<\/h2>\n<p>Patent examiner eligibility rests on three conditions: Indian citizenship (or one of a few notified categories), a qualifying degree in the discipline applied under, and an age of 21 to 35 on the last date of application. Patent officer eligibility is the same test, since &#8220;patent officer&#8221; is the everyday name for this post.<\/p>\n<p>Those conditions come from two documents read together. According to the <a href=\"https:\/\/ipindia.gov.in\/frontend\/pdf\/patents\/service-matters\/Recruitment_Rules_P\/RR%20of%20Examiner%20and%20Controllers.pdf\" target=\"_blank\" rel=\"noopener\">Patent Office (Controllers and Examiners) Recruitment Rules, 2018<\/a>, notified in the Gazette on 25 April 2018, the post needs a master&#8217;s degree in a listed science or a degree in engineering or technology in a listed branch. The subjects are those &#8220;as may be specified in the advertisement on the basis of requirement&#8221;, and the age must be &#8220;not exceeding thirty five years&#8221;. The notification issued for each round of patent examiner recruitment then narrows the subject list into disciplines and adds the minimum age of 21.<\/p>\n<p>That split matters because eligibility is decided discipline by discipline, not by degree level. Nobody applies as &#8220;a science graduate&#8221; or &#8220;an engineer&#8221;. The application is made under one of the 14 disciplines in the notification, and the degree has to match that discipline&#8217;s line. That&#8217;s why the &#8220;B.Sc, M.Sc, BE or BTech&#8221; shorthand repeated on exam-prep pages misleads (a general B.Sc in a pure science qualifies for none of the 14).<\/p>\n<p>Nationality is the first filter. The 2023 notification, the most recent one issued, admits a citizen of India, a subject of Nepal or Bhutan, a Tibetan refugee who came to India before 1 January 1962, or a person of Indian origin who migrated from the countries it specifies. Every category other than Indian citizens needs a certificate of eligibility issued &#8220;on or before the last date of submission of application&#8221;.<\/p>\n<p>The post itself is classified in the 2018 rules as General Central Service, Group A Gazetted and Non-Ministerial, with 673 posts in 2018 &#8220;subject to variation dependent on workload&#8221;. Selection is by direct recruitment. And the column for consulting the Union Public Service Commission reads &#8220;Not applicable&#8221; (the exam section below covers who runs it instead).<\/p>\n<p>The only other way in is narrow. Where a post falls vacant because its holder has gone on deputation or long leave of a year or more, the 2018 rules allow it to be filled on deputation. The officer brought in must have three years&#8217; regular government service at Level 7 and hold the direct-recruit qualifications. For a graduate outside government, patent examiner recruitment through a notified drive is the route.<\/p>\n<p>In practice, the rules are the floor and the advertisement is what binds a given drive. The 2018 rules list Microbiology, Molecular Biology and Bio-Physics as standalone master&#8217;s subjects, while the 2023 notification folded all three into its Bio-Technology discipline. So a candidate reading only the rules can reach a conclusion the notification of the day doesn&#8217;t support.<\/p>\n<p>Which document wins when a coaching page, the rules and the notification disagree? The notification, every time, because it&#8217;s the document the drive is run on.<\/p>\n<a id=\"h3-1a\"><\/a>\n<h3 id=\"degree-required-for-each-discipline\">Degree required for each discipline<\/h3>\n<p>The degree required depends on the discipline: science subjects need a master&#8217;s, while engineering and technology subjects need a bachelor&#8217;s in that branch. Three disciplines (Chemistry, Polymer Science and Technology, and Computer Science and IT) accept either route. Electronics and Communication (108 posts) and Mechanical Engineering (99) together carried 207 of the 553 posts, about 37%, while Metallurgical Engineering had 4 and Textile Engineering 8. By category, the notification reserved 77 posts for SC, 27 for ST, 152 for OBC and 55 for EWS candidates, leaving 242 unreserved, and it earmarked 33 posts for persons with benchmark disabilities (PwBD). It also said plainly that the &#8220;vacancies are tentative&#8221;.<\/p>\n<p>The category split runs inside each discipline, and that&#8217;s the number a candidate is actually competing for. Electronics and Communication&#8217;s 108 posts divided into 15 SC, 6 ST, 30 OBC, 11 EWS and 46 unreserved; Mechanical&#8217;s 99 into 14, 5, 27, 10 and 43. <em>A Mechanical candidate from the OBC category in 2023 was competing for 27 OBC seats in that discipline, not for the 152 OBC seats across the whole drive.<\/em> Of the 33 PwBD posts, 11 were backlog and 22 fresh (7 locomotor, 10 visually impaired, 9 hearing impaired and 7 multiple disabilities), and PwBD candidates must meet the notification&#8217;s physical and medical standards.<\/p>\n<p>The same few degree questions come up in every drive, and the table answers most of them. A general B.Sc in physics, chemistry or the life sciences fits none of the 2023 disciplines, because every pure-science line asks for a master&#8217;s. An MCA is not named: Computer Science and IT asks for a master&#8217;s in computer science or IT, or a BE or BTech in either, and whether an MCA counts as &#8220;equivalent&#8221; is for the notification to settle. <em>A BTech in computer science qualifies under Computer Science and IT directly; a B.Sc in computer science does not, because the science route needs the master&#8217;s.<\/em><\/p>\n<p>Dual and integrated degrees are settled by the same two documents. The 2023 notification accepts each qualification &#8220;or equivalent&#8221; from a university incorporated by a Central or State Act or deemed a university under section 3 of the UGC Act, and the discipline line decides the rest.<\/p>\n<p>Three conditions are notable for being absent. Neither the 2018 rules nor the 2023 notification sets a minimum percentage in the degree (the 2018-19 information bulletin defined divisions only to convert CGPA), and neither asks for work experience. Final-year students are the grey area: the 2018-19 bulletin required the degree &#8220;on the closing date of the receipt of application&#8221;, while the 2023 notification says only that candidates &#8220;must hold a degree&#8221;. Candidates should ensure that they satisfy the educational qualification requirements specified in the applicable recruitment notification unless a future notice says otherwise.<\/p>\n<p>The discipline list has widened between drives. According to the 2018-19 information bulletin, that drive advertised 220 examiner posts in eight disciplines, led by Electronics and Telecommunication (70 posts) and Computer Science and IT (55). The 2023 notification went to 14, adding Bio-Technology, Food Technology, Physics, Civil, Mechanical and Textile as separate lines.<\/p>\n<p>But the current workforce still reflects the older mix. The IP India Annual Report 2024-25 lists 626 examiners by subject in its appendix, with Electrical and Electronics the largest group at 181, followed by Chemistry at 96, Computer and IT at 88 and Mechanical at 87. Civil, Food Technology and Metallurgical had 7 examiners each.<\/p>\n<a id=\"h3-1b\"><\/a>\n<h3 id=\"patent-examiner-age-limit\">Patent examiner age limit<\/h3>\n<p>The patent examiner age limit is 21 to 35 years on the last date of the online application, with relaxations that raise the ceiling for reserved categories. The 2023 notification words it as having &#8220;attained the age of 21 years&#8221; and not having &#8220;attained the age of 35 years&#8221; on that date. The 2018 rules set only the ceiling of 35 and a relaxation of up to five years for government servants, and they make the closing date for receipt of applications the date on which age is measured. SC, ST and OBC candidates who also fall under the ex-servicemen or PwBD clauses get the relaxations cumulatively (an SC candidate who also qualifies as PwBD adds 5 years and 10, for an upper limit of 50). The notification lists no age relaxation for EWS candidates. <em>If a notification&#8217;s last date is 31 July, a general-category candidate must have turned 21 by that day and must not yet have turned 35; an OBC candidate has until 38 and an SC or ST candidate until 40.<\/em><\/p>\n<p>Proof of age is narrow. The 2023 notification accepts the date of birth only from the matriculation or secondary certificate, or an equivalent, and it rules out horoscopes, affidavits, municipal birth extracts and service records. Once a date of birth is entered in the application, no later change is allowed on any ground. The name, date of birth and parents&#8217; names must also be written exactly as they appear on the matriculation certificate, or the candidature can be cancelled at document verification.<\/p>\n<p>What about attempts? The notifications do not cap them, and neither do the rules, so the age ceiling is the only limit on how many drives a candidate can sit. And because drives have come years apart (2018-19, then 2023-24), the ceiling is also the practical constraint.<\/p>\n<p>One relaxation has gone. The 2018-19 bulletin gave five extra years to candidates domiciled in Jammu and Kashmir between 1980 and 1989, and the 2023 notification dropped it.<\/p>\n<p>One mix-up is common. The age figure quoted most often online, 30 for general candidates, belongs to the Trade Marks examiner post that UPSC advertised in December 2025, and it doesn&#8217;t apply to the patent post.<\/p>\n<a id=\"h2-2\"><\/a>\n<h2 id=\"patent-examiner-recruitment-exam\">Patent examiner recruitment exam<\/h2>\n<p>The patent examiner recruitment exam is run by an outside agency engaged for each drive, not by UPSC, and in 2023-24 that agency was the National Testing Agency. According to the 2018 rules, recruitment follows &#8220;the procedure or mechanism approved by the Central Government from time to time&#8221;, and UPSC consultation is marked &#8220;Not applicable&#8221;. That one line is the legal basis for handing the exam to outside agencies.<\/p>\n<p>It wasn&#8217;t always this way. A government committee on examiner recruitment, set up by the Department of Industrial Policy and Promotion (DIPP) in December 2008, reported in 2009 that UPSC recruited examiners until 1999 under rules notified on 31 October 1983. Rules notified on 13 July 2001 then took recruitment out of UPSC and placed it with DIPP, according to the same report. The committee recommended a specialised external agency, because &#8220;the Office of the CGPDTM does not have enough resources&#8221; for recruitment on that scale.<\/p>\n<p>The last two drives show how much the machinery changes between rounds. The 2018-19 drive, for 220 posts, took applications on a dedicated CGPDTM recruitment portal from 6 August to 4 September 2018 and selected on the written exam alone, with no interview. The 2023 drive was advertised by the Quality Council of India (QCI), with applications open from 14 July to 4 August 2023. NTA then took it over, and its public notice of 11 December 2023 said NTA had been &#8220;entrusted with the responsibilities of conducting the Recruitment for the Post of Examiner of Patents and Designs against 553 vacancies&#8221;.<\/p>\n<p>A drive is announced through a recruitment notification on the conducting agency&#8217;s website (qcin.org in 2023), and that document carries the fee, the dates, the disciplines and the seat split. In 2023 the fee was Rs 1,000 for General and OBC candidates and Rs 500 for SC, ST and PwD candidates, women of all categories &#8220;and any other person&#8221;. Back in 2018 it was Rs 200, with SC, ST, PH and women candidates exempt.<\/p>\n<p>Why does the agency matter to a candidate? Because the pattern, the mode and the marking scheme are written into each notification rather than fixed by the rules, and 2018 and 2023 differed on the interview, the papers and the mode of the test. The one element that carried over from 2018 to 2023 was a 300-mark descriptive paper in the candidate&#8217;s own discipline.<\/p>\n<p>The recent UPSC notice naming CGPDTM, Advertisement No. 14\/2025, is for the Trade Marks and Geographical Indications examiner post, not this one.<\/p>\n<a id=\"h3-2a\"><\/a>\n<h3 id=\"exam-pattern-and-syllabus\">Exam pattern and syllabus<\/h3>\n<p>The exam pattern in the 2023 notification had three stages: a 150-mark online prelim that only screens, a two-paper mains worth 400 marks, and a 100-mark interview. Candidates write the mains in their own hand, a scribe is allowed only for PwBD candidates under the relevant rules, and where handwriting isn&#8217;t easily legible &#8220;the relevant answer shall be treated as incorrect&#8221;.<\/p>\n<p>What was advertised and what was held were not the same. The QCI notification set the mains offline with an OMR-based Paper I. But NTA, according to its notices of 11 December 2023 and 26 March 2024, held the prelim and Paper I as computer-based tests and Paper II as an offline descriptive test in 14 disciplines.<\/p>\n<p>The prelim and Paper I syllabi are the section lists in the table. Both carry an intellectual property component (15 marks of IP legislation, WIPO and related treaties in the prelim, 20 marks of IPR knowledge in Paper I). That makes a working grasp of <a href=\"https:\/\/skillarbitra.ge\/blog\/complete-guide-to-patents-in-india\/\" target=\"_blank\" rel=\"noopener\">how the patent system works in India<\/a> part of the preparation even for an engineer.<\/p>\n<p>Paper II is where the syllabi part ways. The notification&#8217;s annexure prints a separate syllabus for each of the 14 disciplines, following the core subjects of each degree. Electronics and Communication runs from materials and components, electron devices and ICs, signals and systems and network theory through electromagnetic theory, measurements, analog and digital circuits, control systems, communication systems and microwave engineering. Mechanical covers mechanics of rigid and deformable bodies, engineering materials, theory of machines, manufacturing science and management, thermodynamics and gas dynamics, heat transfer, IC engines, steam engineering, and refrigeration and air-conditioning.<\/p>\n<p>Computer Science and IT lists digital logic, computer organisation and architecture, programming in C and data structures, algorithms, theory of computation, compiler design, operating systems, databases, software engineering, computer networks and web technologies. Chemistry splits into inorganic, physical and organic chemistry, plus an interdisciplinary block that includes nanoscience, catalysis and green chemistry, medicinal chemistry and environmental chemistry. The other ten disciplines follow the same pattern.<\/p>\n<p>The 2023 pattern is heavier than the one it replaced. According to the 2018-19 information bulletin, the prelim then was an offline OMR test with five 30-mark sections, the mains was a 300-mark descriptive subject paper plus a qualifying 100-mark English paper, and there was no interview at all. The 2023 notification added the IP sections to the prelim and Paper I and brought in the 20% interview.<\/p>\n<p>Candidates who sat the 2023-24 exam have said publicly that the discipline paper decides rank, so they prepared their core subject first and general knowledge second. That&#8217;s a community view, not an official one. But the arithmetic backs it: Paper II is 300 of the 400 mains marks, and the mains carries 80% of the final score, which puts the discipline paper alone at 60% of the final list.<\/p>\n<a id=\"h3-2b\"><\/a>\n<h3 id=\"merit-list-and-cut-offs\">Merit list and cut-offs<\/h3>\n<p>The merit list is built from the mains (80%) and the interview (20%); the prelim score is dropped once a candidate clears the screening minimum. Because the 14 disciplines sit different Paper II question papers, the 2023 notification normalises scores within each discipline before placing everyone on one common seniority list. Document verification follows that final list, and only then comes an offer to join.<\/p>\n<p>The formula is short. The highest marks in each discipline count as 100%, and every other candidate in that discipline gets 100 multiplied by their own marks, divided by the highest marks in that subject. Ties go to the elder candidate, then to alphabetical order by first name. <em>As an illustration with made-up marks: if the top Mechanical candidate scores 320 and another Mechanical candidate scores 272, the second candidate&#8217;s normalised score is 100 x 272 \/ 320 = 85.<\/em><\/p>\n<p>Think of it this way: a candidate is ranked against the best performer in their own discipline, not against the whole field. A hard Paper II in one subject doesn&#8217;t drag that discipline&#8217;s candidates down the common list, because its top scorer still sits at 100.<\/p>\n<p>Cut-offs are a different matter. None of NTA&#8217;s public notices for the 2023-24 drive states a cut-off for any stage, and the &#8220;non-declaration of results and cut-offs for all examinations, interviews and merit lists&#8221; was one of the petitioners&#8217; grievances recorded in the Delhi High Court&#8217;s judgment of 30 August 2024. The 30%, 25% and 20% figures are prelim qualifying minimums, not cut-offs, and the notification reserves to CGPDTM the rules for the cut-off at every stage. Cut-off tables that circulate online for the 2023-24 drive do not come from any NTA or CGPDTM notice, so none of them carries an issuing authority.<\/p>\n<p>Paper II was never opened up either. NTA&#8217;s notice of 26 March 2024 says question papers and provisional answer keys were displayed for Paper I only. The same judgment records the petitioners&#8217; complaint that the Paper II paper and key were not disclosed, so no official previous-year Paper II exists to practise from.<\/p>\n<a id=\"h3-2c\"><\/a>\n<h3 id=\"patent-examiner-recruitment-in-2023-24\">Patent examiner recruitment in 2023-24<\/h3>\n<p>Patent examiner recruitment in 2023-24 produced 550 recommended candidates for 553 advertised posts and took about 18 months from advertisement to joining.<\/p>\n<p>QCI advertised the posts in July 2023 and held the prelim online on 3 September 2023, then cancelled it the next day citing &#8220;some irregularities\/ technical glitches&#8221;, according to reporting by the IP blog SpicyIP (QCI&#8217;s own notice is no longer online). NTA&#8217;s notice of 11 December 2023 confirmed that it had taken over. It re-ran the prelim on 21 December 2023 at 260 centres in 103 cities for about 89,657 scheduled candidates. The mains followed on 25 January 2024, with a second date on 5 February 2024 for affected candidates, for about 10,474 candidates in 77 cities.<\/p>\n<p>NTA declared the mains result on 26 March 2024 and called about five times the 553 vacancies to interviews held between 1 and 25 April 2024. The final result followed in mid-June 2024, with 550 candidates provisionally recommended against the 553 posts. CGPDTM then verified their original documents on 11 and 12 July 2024 at the four patent offices in Chennai, Delhi, Kolkata and Mumbai.<\/p>\n<p>According to the Annual Report, 407 of the 550 joined in the second and third weeks of January 2025 for a 16-week induction. Of those, 283 trained at the Rajiv Gandhi National Institute of Intellectual Property Management (RGNIIPM) in Nagpur, while 124 from Electronics and Communication and Computer Science went to the Dr MCR HRD Institute in Hyderabad. The report expected them to begin full examination work in the second half of 2025-26. But it doesn&#8217;t account for the other 143.<\/p>\n<p>Candidates did go to court. Two writ petitions in the Delhi High Court (W.P.(C) 10134\/2024 and 6743\/2024) challenged centre allotment, the negative-marking position in Paper I, the undisclosed Paper II paper and key, and the missing cut-offs. On 30 August 2024 the court dismissed them as not maintainable, holding that &#8220;the remedy of the Petitioners clearly lies before the Administrative Tribunal&#8221;, without expressing any opinion on the merits. The practical point for any future drive: recruitment disputes of this kind belong before the Central Administrative Tribunal.<\/p>\n<p>The delay had a cost inside the office. The Annual Report states that &#8220;the delay in recruiting new examiners, due to legal hurdles, resulted in increased pendency at the first examination stage for patents&#8221;. It also notes that about 370 examiners were promoted to Controllers in 2023, which thinned the examiner ranks while the new batch was still working through the process.<\/p>\n<p>Will there be another drive soon? A Lok Sabha reply published by PIB on 22 July 2025 put the Patent Office&#8217;s sanctioned strength at 1,433 in 2024 against 833 people in post, figures for the whole office rather than examiners alone. That gap points to another drive in principle, but no fresh round of patent examiner recruitment has been notified. And the October 2023 remark by the DPIIT Secretary, reported by Business Standard, that the office would hire about 900 more people described recruitment &#8220;already underway&#8221; at the time, not a future round.<\/p>\n<p>The 2023-24 drive carries a practical lesson for anyone working out how to become a patent examiner in the next round: the matriculation certificate, degree and category certificates need to be ready before a notification lands. Under the Central Civil Services (Implementation of National Pension System) Rules, 2021, an examiner contributes 10% of basic plus DA to the National Pension System, Rs 8,976 a month at entry, and the government adds 14%, which the rules round up to Rs 12,567. Income tax then depends on the regime the examiner chooses, which is why no single in-hand figure holds for every reader.<\/p>\n<p>Over a year, the metro gross comes to about Rs 14.17 lakh before any deduction, at the current DA rate.<\/p>\n<p>Pay grows without any promotion, by one cell of the matrix for each annual increment, roughly 3% a step. <em>After five annual increments an examiner reaches cell 6 of Level 10, a basic of Rs 65,000, before any promotion and before DA is added on top.<\/em> Ten increments take the basic to Rs 75,400 at cell 11, and the first promotion moves the examiner onto Level 11, whose first cell is Rs 67,700.<\/p>\n<p>The next structural change is the 8th Pay Commission. The government constituted it by a Department of Expenditure resolution of 3 November 2025, with recommendations due within 18 months of that date, and it was still holding consultations in September 2026. No official figure for revised Level 10 pay exists yet.<\/p>\n<p>Salary pages built on DA of 34% to 50%, a Rs 5,000 transport allowance, or private-sector &#8220;patent examiner&#8221; salaries from aggregator sites don&#8217;t reflect the current orders. DA sat in that range in earlier years (it reached 50% only in January 2024), the 2017 transport order fixes Rs 7,200 plus DA at this level, and aggregator figures describe private jobs. Every promotion also needs two to four weeks of IPR training from a government or government-recognised institute such as RGNIIPM, and the decision goes to a departmental promotion committee chaired by the Joint Secretary (Administration) of CGPDTM. On paper that&#8217;s 17 years from examiner to Senior Joint Controller at the earliest (5 + 5 + 5 + 2). The actual pace depends on vacancies and on when the committees meet.<\/p>\n<p>Two rules soften the service requirement at the edges. Where a junior who meets the service period is being considered, a senior who falls short of it by no more than half the period, or two years, whichever is less, is considered too. And the Senior Joint Controller grade is filled by promotion, failing which by deputation, including on short-term contract.<\/p>\n<p>The pyramid narrows quickly: in 2018, 196 Assistant Controller posts sat above 673 examiner posts. <em>An examiner who joined in January 2025 first meets the five-year service requirement for Assistant Controller in January 2030, and still needs the IPR training and a vacancy.<\/em> Promotions have come in large batches too, and the Annual Report 2024-25 notes about 370 examiners promoted to Controllers in 2023.<\/p>\n<p>The Controller General isn&#8217;t the top of this ladder. That office is filled by appointment under section 3(1) of the Trade Marks Act, 1999, and its holder acts as Controller of Patents under section 73(1) of the Patents Act, outside these recruitment rules.<\/p>\n<p>The job comes with conditions attached. Examiners serve two years on probation before a departmental confirmation committee confirms them. The 2018-19 bulletin stated that selected candidates are &#8220;liable to be posted anywhere in India in the offices under the office of CGPDTM&#8221;. The Patent Office itself works from Chennai, Delhi, Kolkata and Mumbai, with the Designs Wing in Kolkata and RGNIIPM and the Patent Information System in Nagpur.<\/p>\n<p>Pension runs through the National Pension System, with the Unified Pension Scheme (UPS), operational from 1 April 2025, available as an option chosen within 30 days of joining. And PIB has reported a one-time, one-way switch from UPS back to NPS, allowed at least a year before superannuation. Any outside trade, business or employment needs previous sanction under rule 15 of the CCS (Conduct) Rules, 1964.<\/p>\n<p>The Patents Act adds two restrictions of its own. Section 75 makes officers &#8220;incapable, during the period for which they hold their appointments, to acquire or take, directly or indirectly, except by inheritance or bequest, any right or interest in any patent issued by that office&#8221;. Section 76 bars them, except as authorised, from preparing or assisting in the preparation of any document to be lodged in the patent office, which rules out drafting for applicants while in service.<\/p>\n<p>Leaving the office opens one door. Under <a href=\"https:\/\/ipindia.gov.in\/frontend\/pdf\/patents\/1_113_1_The_Patents_Act__1970___incorporating_all_amendments_till_1-08-2024.pdf\" target=\"_blank\" rel=\"noopener\">section 126(1)(c)(iii) of the Patents Act, 1970<\/a>, a person who has worked as an examiner or as a Controller, or both, for a total of at least ten years, and no longer holds that role when applying, can register as a patent agent without sitting the qualifying exam. EPO examiner appointments are generally for up to five years, with a one-year probation. At the USPTO, pay climbs steeply with grade on the same special rate table: GS-12 runs from $107,813 to $140,160 and GS-13 from $131,841 to $171,396.<\/p>\n<p>The UK is the partial exception. Civil Service nationality rules open about 75% of posts to Commonwealth citizens and EEA nationals and reserve about 25%, and Indian citizens are Commonwealth citizens. A right to work in the UK is still needed, though, and recent UKIPO adverts have not offered visa sponsorship. The IPO also advertises a Scarce Skills Allowance of \u00a34,371 that may be paid to candidates with specific telecoms knowledge.<\/p>\n<p>Private patent work isn&#8217;t tied to nationality in the same way. Searching and drafting for foreign applicants is done by private practitioners, and <a href=\"https:\/\/skillarbitra.ge\/blog\/become-a-patent-agent-india-complete-guide\/\" target=\"_blank\" rel=\"noopener\">becoming a registered patent agent in India<\/a> is the qualification that lets a practitioner file on an applicant&#8217;s behalf at the Indian office. For an Indian national without foreign citizenship or UK work rights, the realistic government examiner route is the Indian Patent Office.<\/p>\n<h2 id=\"faqs\">FAQs<\/h2>\n<p><strong>What does a patent examiner do?<\/strong><\/p>\n<p>A patent examiner examines patent applications under section 12 of the Patents Act, 1970, reporting to the Controller on compliance with the Act and rules, any lawful ground of objection, and the results of the anticipation searches under section 13. The work means searching patent and non-patent literature for novelty, judging inventive step and industrial application, and assigning the IPC classification. The same officer also acts as examiner under the Designs Act, 2000.<\/p>\n<p><strong>Is there negative marking in the patent examiner exam?<\/strong><\/p>\n<p>The 2023 notification doesn&#8217;t state a negative-marking rule for any stage. The 2018 prelim deducted 33% of a mark for each wrong answer, and petitioners in the 2024 Delhi High Court case complained of &#8220;no clarity on negative marking for Mains Paper-I&#8221;. Until a new notification settles it, candidates should read its scheme of examination closely before deciding how many questions to attempt.<\/p>\n<p><strong>What is the difference between a patent examiner and a patent agent?<\/strong><\/p>\n<p>A patent examiner is a Group A government officer who examines applications for the Patent Office; a patent agent is a registered practitioner who drafts and files them for applicants. Agents must be 21, hold a science, engineering or technology degree and pass the Patent Agent Examination, which CGPDTM says is likely to be held on 10 January 2027. Section 76 bars serving examiners from agent-type work, and <a href=\"https:\/\/skillarbitra.ge\/blog\/patent-agent\/\" target=\"_blank\" rel=\"noopener\">the patent agent&#8217;s role<\/a> covers the other side.<\/p>\n<p><strong>Can B.Pharm or M.Pharm graduates become patent examiners?<\/strong><\/p>\n<p>Pharmacy isn&#8217;t among the subjects listed in the 2018 Recruitment Rules or the 2023 notification, so a pharmacy degree on its own doesn&#8217;t meet any discipline&#8217;s qualification. A candidate who also holds a listed degree, such as a master&#8217;s in chemistry or biotechnology, applies under that discipline instead.
