Notification G.S.R. 843(E) places section 5 of the Digital Personal Data Protection Act, 2023, which governs notice, and section 6(1) to (8) and (10), which governs consent, in an eighteen-month commencement tranche, together with rule 3 of the Digital Personal Data Protection Rules, 2025. Only section 6(9), the Consent Manager provision, arrives earlier, at twelve months in November 2026. Until the eighteen-month date, consent for sensitive personal data is still governed by the older SPDI Rules 2011 made under the Information Technology Act, 2000.<\/p>\n<p>This article sets out the DPDP Act consent and notice rules as the Gazette text states them.<\/p>\n<p>The gap between notification and commencement explains most of what is now circulating about these provisions. A notification fixes the text of a law. A commencement date fixes when it starts to bind, and here the two sit eighteen months apart. That is not a drafting quirk either, because section 1(2) of the Act expressly allows different dates for different provisions, and the Ministry of Electronics and Information Technology used it.<\/p>\n<p>One misreading has travelled particularly far. Several outlets reported that companies have until November 2026 to appoint a Consent Manager. Section 6(9) says nothing of the kind: it permits a Data Principal to give, manage, review and withdraw her consent through a Consent Manager registered with the Data Protection Board of India, and rule 4 sets out how an entity applies to become one. Notification G.S.R. 843(E), issued by the Ministry of Electronics and Information Technology on 13 November 2025 under section 1(2) of <a href=\"https:\/\/www.meity.gov.in\/static\/uploads\/2024\/06\/2bf1f0e9f04e6fb4f8fef35e82c42aa5.pdf\" target=\"_blank\" rel=\"noopener\">the Digital Personal Data Protection Act, 2023<\/a>, splits the Act into three tranches by date.<\/p>\n<p>Tranche one commenced on publication. It carries the definitions in section 2, the establishment and functioning of the Data Protection Board of India in sections 18 to 26, the rule-making powers in sections 40 to 43, and the amendments that make the Telecom Disputes Settlement and Appellate Tribunal the appeal forum and narrow section 8(1)(j) of the Right to Information Act, 2005. None of it asks a business to do anything.<\/p>\n<p>Tranche two, at twelve months, carries exactly two provisions: section 6(9) and section 27(1)(d) (the pair that opens Consent Manager registration). Tranche three, at eighteen months, carries everything else that matters here, including sections 3 to 5, section 6(1) to (8) and (10), sections 7 to 17, and the whole of the penalty power in sections 28 to 34.<\/p>\n<p>Rule 1 of the <a href=\"https:\/\/www.meity.gov.in\/static\/uploads\/2025\/11\/53450e6e5dc0bfa85ebd78686cadad39.pdf\" target=\"_blank\" rel=\"noopener\">Digital Personal Data Protection Rules, 2025<\/a> mirrors that split. Rules 1, 2 and 17 to 21 commenced on publication, rule 4 commences at twelve months, and rules 3, 5 to 16, 22 and 23 commence at eighteen months. Rule 3 is the notice rule. So the statutory duty and the rule that fleshes it out arrive on the same day, which is unusual and worth planning around.<\/p>\n<p>Read together, that puts every operative element of the notice and consent regime on one date. The section 5 notice, the section 6 consent standard, the section 6(4) withdrawal right, the section 7 legitimate uses, the section 9 children&#8217;s rules and rule 3&#8217;s presentation conditions all commence at once, and neither the Act nor the Rules carries any transitional relief. There&#8217;s no staged onboarding here. That&#8217;s the planning fact that matters most.<\/p>\n<p>Worth flagging: the notifications are dated 13 November 2025, but several law firms record publication in the Official Gazette as 14 November and compute the milestones from there. The practical difference is one day at each end (13 or 14 November 2026, and 13 or 14 May 2027). Plan to the earlier date and you&#8217;re correct under either reading.<\/p>\n<p>Meanwhile, consent duties already exist. They just sit in a different statute.<\/p>\n<p>Section 44(2) of the DPDP Act, which deletes section 43A of the Information Technology Act, 2000 and the rule-making power behind the SPDI Rules 2011, is itself in the eighteen-month tranche. Until May 2027, then, the <a href=\"https:\/\/www.indiacode.nic.in\/ViewFileUploaded?path=AC_CEN_45_76_00001_200021_1517807324077%2Frulesindividualfile%2F&#038;file=GSR313E_10511%281%29_0.pdf\" target=\"_blank\" rel=\"noopener\">Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011<\/a> remain in force, with their published privacy policy requirement, their consent requirement for collecting sensitive personal data, and their grievance officer. A business treating 2026 as a consent-free window is reading the wrong law.<\/p>\n<p>So can the DPDP Act&#8217;s substantive consent and notice obligations be enforced right now? Not yet. The relevant provisions, including section 5 and most of section 6, are in the eighteen-month commencement tranche, and section 33&#8217;s penalty provisions are also not yet in force. Section 33, the penalty power, is not in force. And the Data Protection Board of India, established in law by notification G.S.R. 844(E) on 13 November 2025 and fixed at four Members besides a Chairperson, has nobody sitting in it: <a href=\"https:\/\/www.meity.gov.in\/static\/uploads\/2026\/05\/cd481c027470b420b4cb85fb40a91c53.pdf\" target=\"_blank\" rel=\"noopener\">MeitY&#8217;s circular of 6 May 2026<\/a> invited applications for the Chairperson and the four Member posts, and <a href=\"https:\/\/www.livelaw.in\/articles\/india-data-protection-board-established-law-543751\" target=\"_blank\" rel=\"noopener\">reporting on 1 August 2026<\/a> recorded that none had been filled.<\/p>\n<p>That returns us to the November 2026 date and what it actually opens. Rule 4 sets out a registration procedure: an entity applies to the Board, and the Board may inquire into the application, register it and publish its particulars, or reject it with reasons. Part A of the First Schedule sets the bar for applying, and it&#8217;s high. Incorporation in India, sufficient technical, operational and financial capacity, a net worth of not less than two crore rupees, and independent certification that the applicant&#8217;s interoperable platform meets a data protection standards and assurance framework the Board has yet to publish.<\/p>\n<p>A Consent Manager is a licensed intermediary, in other words, not software an SME installs. And if the Board is still unstaffed in November 2026, nobody can register at all, because rule 4 registration runs through the Board.<\/p>\n<p>One date could still move. MeitY held a <a href=\"https:\/\/ssrana.in\/articles\/meity-plans-to-cut-short-dpdp-compliance-timeline-and-notify-cross-border-restrictions-for-sdfs\/\" target=\"_blank\" rel=\"noopener\">stakeholder consultation in January 2026<\/a> proposing to compress the eighteen-month window to twelve for Significant Data Fiduciaries and to notify cross-border restrictions. It hasn&#8217;t been notified, so May 2027 governs. Our recommendation for anyone building a programme around <a href=\"https:\/\/skillarbitra.ge\/blog\/dpdp-act-compliance-checklist\/\" target=\"_blank\" rel=\"noopener\">the wider DPDP Act obligations<\/a> is to treat the duties as fixed and the dates as the only movable part.<\/p>\n<h2 id=\"h2-2\">What the DPDP Act consent and notice rules require in a notice<\/h2>\n<p>The DPDP Act consent and notice rules require the notice to carry three items, and rule 3 adds three conditions on how those items are presented. Section 5(1) states that every request for consent must be accompanied or preceded by a notice informing the Data Principal of the personal data being collected and the purpose for which it will be processed, the manner in which she may exercise her rights under section 6(4) and section 13, and the manner in which she may make a complaint to the Board. That&#8217;s the whole statutory list. Everything else in a typical Indian privacy notice is either rule 3 detail or surplus.<\/p>\n<p>Does a link to the privacy policy discharge it? Not under rule 3(a), which requires the notice to be presented and to be understandable independently of any other information. That single clause disposes of the most common implementation on Indian websites, which is a line of consent text under a signup button pointing at a policy somewhere else. A notice buried inside terms of service isn&#8217;t understandable independently of them.<\/p>\n<p>Rule 3(b) is where the drafting work sits. It requires clear and plain language and, specifically, an itemised description of the personal data, together with the specified purpose and a specific description of the goods or services to be provided or the uses to be enabled. Itemised is the operative word. &#8220;Contact and usage data&#8221; isn&#8217;t an itemised description; &#8220;name, mobile number, email address, billing address and order history&#8221; is (and yes, that is the granularity rule 3(b) asks for).<\/p>\n<p>Behind that sits an inventory problem, and it&#8217;s the reason notice drafting stalls. You can&#8217;t itemise personal data nobody has mapped, which is the same discipline a formal <a href=\"https:\/\/skillarbitra.ge\/blog\/gdpr-article-30-records-of-processing\/\" target=\"_blank\" rel=\"noopener\">record of processing activities<\/a> enforces under a different regime. Most Indian firms discover at this point that no single person knows every field the signup form, the CRM and the support desk collect between them.<\/p>\n<p>Rule 3(c) closes the notice. It requires the particular communication link for the Data Fiduciary&#8217;s website or app, plus a description of the other means by which the Data Principal may withdraw her consent with comparable ease, exercise her rights under the Act, and complain to the Board. But note the word &#8220;particular&#8221;: a link to the homepage doesn&#8217;t satisfy it.<\/p>\n<p>And section 5(3) adds the language option. The Data Principal must be given the option of accessing the notice in English or in any language listed in the Eighth Schedule to the Constitution. It&#8217;s an option to be offered, not twenty-two translations to be published in advance.<\/p>\n<p>And then there&#8217;s section 5(2), the provision most likely to catch an established business. Where consent was obtained before the section commences, the Data Fiduciary must, as soon as reasonably practicable, give the Data Principal a notice carrying the same three items, and processing may continue until she withdraws consent. That reaches the legacy CRM, the newsletter list built in 2019 and the WhatsApp broadcast group alike.<\/p>\n<p>Here&#8217;s what a compliant notice actually looks like. Take an Indian SaaS company collecting data at signup, and draft to section 5(1), section 5(3) and rule 3: <em>We collect your name, work email address, mobile number, company name and billing address, in order to create and operate your account, process your subscription payments, and provide customer support. You can withdraw your consent, ask for a summary of the personal data we hold about you, ask us to correct or erase it, or nominate someone to exercise your rights for you, at https:\/\/example.in\/privacy-request or privacy@example.in, in the same number of steps it took you to consent. You can raise a grievance at the same address, and if it is not resolved, complain to the Data Protection Board of India. This notice is available in English and in the languages of the Eighth Schedule to the Constitution at https:\/\/example.in\/notice-languages.<\/em><\/p>\n<p>Every clause there maps to a provision. The itemised data and the stated purpose answer rule 3(b), the withdrawal and rights route answers rule 3(c) with section 5(1)(ii), the Board line answers section 5(1)(iii), and the closing sentence answers section 5(3).<\/p>\n<p>But what the example leaves out matters as much as what it carries. There&#8217;s no security description, no retention schedule and no list of processors, because rule 3(a)&#8217;s standalone comprehension test gets harder with every paragraph added. Frankly, this gets overlooked. five adjectives and one limit, all of them in section 6(1). Consent must be free, specific, informed, unconditional and unambiguous with a clear affirmative action; it must signify agreement to the processing of personal data for the specified purpose; and it must be limited to such personal data as is necessary for that specified purpose.<\/p>\n<p>Those five adjectives do different jobs. &#8220;Free&#8221; and &#8220;unconditional&#8221; bite on bundling, so consent extracted as the price of a service that does not need it fails both. &#8220;Specific&#8221; bites on the omnibus clause that sweeps marketing, analytics, profiling and partner sharing into one tick. And the necessity limit at the end of section 6(1) is the one most often missed, because it operates independently of what the reader agreed to: even freely given consent does not authorise collecting data the specified purpose does not require.<\/p>\n<p>That necessity test is the same one <a href=\"https:\/\/skillarbitra.ge\/blog\/privacy-impact-assessment-steps-and-template\/\" target=\"_blank\" rel=\"noopener\">a privacy impact assessment<\/a> exists to document.<\/p>\n<p>&#8220;Unambiguous with a clear affirmative action&#8221; rules out inference. A pre-ticked box isn&#8217;t a clear affirmative action. Neither is continued use of a service, nor silence.<\/p>\n<p>And section 6(2) goes further, making any part of a consent that infringes the Act, the Rules or any other law invalid to the extent of the infringement. The Act supplies its own illustration: a clause by which a person agrees not to complain to the Board is void, while the rest of the consent survives. Partial invalidity, not wholesale.<\/p>\n<p>Section 6(3) governs the request rather than the consent. It must be in clear and plain language, offer English or any Eighth Schedule language, and give the contact details of a Data Protection Officer where applicable, or of another authorised person (the Act&#8217;s own phrase).<\/p>\n<p>That qualifier is widely misread. A Data Protection Officer is required only of a Significant Data Fiduciary under section 10(2)(a), and section 2(l) defines the office by reference to that appointment, so everyone else simply publishes a person who can answer questions about the processing under section 8(9). That&#8217;s a named role rather than a certification, though the <a href=\"https:\/\/skillarbitra.ge\/blog\/data-privacy-consultant-career-india\/\" target=\"_blank\" rel=\"noopener\">privacy consulting<\/a> market has grown up around it.<\/p>\n<p>Withdrawal is where most consent flows will fail. How easy is easy enough? Section 6(4) gives the Data Principal the right to withdraw at any time, &#8220;with the ease of doing so being comparable to the ease with which such consent was given&#8221;. If consent was one tap inside an app, withdrawal can&#8217;t be an email to a support desk that answers in three working days.<\/p>\n<p>That comparability test is checkable in a way most of the Act isn&#8217;t. Count the steps in, count the steps out.<\/p>\n<p>Sections 6(5) and 6(6) set the consequences, and they&#8217;re more balanced than most privacy training assumes. The Data Principal bears the consequences of her own withdrawal, prior processing is not invalidated, and the Data Fiduciary must within a reasonable time cease processing and cause its Data Processors to cease. Section 8(7) then bites, requiring erasure on withdrawal or when the specified purpose is no longer served, whichever is earlier, unless a law requires retention. So a single withdrawal is an erasure trigger that runs down the vendor chain.<\/p>\n<p>But consent isn&#8217;t the only lawful ground, and this is where a good deal of compliance effort gets wasted. Section 4 permits processing on consent or on a legitimate use listed in section 7. Section 7(a) covers the purpose for which the Data Principal voluntarily provided her data and has not indicated that she does not consent, which is the ordinary footing for someone filling in a contact form. Section 7(i) covers employment purposes, including safeguarding the employer from loss or liability and providing a service or benefit sought by an employee.<\/p>\n<p>The mistake we see most often is collecting consent where section 7 already covers the processing. Doing that manufactures a withdrawal right, and with it an erasure trigger, that the section 7 route never carried.<\/p>\n<p>Drafted to section 6(1) and section 6(3), the consent request itself is shorter than most companies expect. For the same signup: <em>I agree that [Company] may process the personal data itemised in the notice above, for the purposes stated in it.<\/em> One purpose set, one affirmative action, nothing bundled. Marketing gets its own separate tick, or it doesn&#8217;t get consent at all.<\/p>\n<h3 id=\"h3-3a\">Verifiable parental consent for children&#8217;s data<\/h3>\n<p>Children&#8217;s data is the one place where the consent rules change shape rather than degree. Section 2(f) sets the age at eighteen, well above the thirteen most global platforms are built around. Section 9(1) requires verifiable consent of the parent, or of the lawful guardian of a person with a disability, before any processing. Section 9(3) generally prohibits tracking, behavioural monitoring and targeted advertising directed at children. Parental consent by itself does not override that prohibition, although the Act and Rules provide specified exemptions and carve-outs for certain classes of Data Fiduciaries and purposes.<\/p>\n<p>Rule 10 supplies the mechanics. The Data Fiduciary must observe due diligence that the person identifying herself as the parent is an adult who is identifiable if required under any law, by reference either to reliable identity and age details it already holds, or to details voluntarily provided or verified through a virtual token issued by an authorised entity, which includes a Digital Locker service provider (DigiLocker, in practice). Rule 12 and the Fourth Schedule then carve out narrow, purpose-bound exemptions for clinical establishments and healthcare professionals, educational institutions, creches, and the transport providers those institutions engage.<\/p>\n<h2 id=\"h2-4\">Frequently asked questions<\/h2>\n<p><strong>Do the DPDP Act consent and notice rules apply to a company based outside India?<\/strong><\/p>\n<p>Yes, where the processing is connected with offering goods or services to Data Principals within India. Section 3(b) applies the Act extraterritorially where processing outside India is connected with offering goods or services to Data Principals within India. The Act also contains exclusions under section 3(c), including processing by an individual for personal or domestic purposes and certain personal data made publicly available.<\/p>\n<p><strong>Does the DPDP Act require consent to be recorded and stored?<\/strong><\/p>\n<p>Not expressly. Nothing in the Act or the Rules directs a Data Fiduciary to keep a consent register. Not expressly. Nothing in the Act or the Rules expressly requires every Data Fiduciary to maintain a consent register or prescribes a general consent-record format. However, because the Data Fiduciary remains responsible for complying with the Act and the Rules, maintaining appropriate records of consent may be necessary to demonstrate compliance.<\/p>\n<p><strong>What penalty applies to a defective consent notice under the DPDP Act?<\/strong><\/p>\n<p>Up to fifty crore rupees, under entry 7 of the Schedule, the residual entry for any provision not separately listed. It&#8217;s a ceiling, not a tariff: section 33(1) allows a penalty only where the Board finds, after an inquiry, that the breach is significant. Section 33 commences in May 2027.<\/p>\n<p><strong>How quickly must a business act on a withdrawal of consent?<\/strong><\/p>\n<p>Within a reasonable time. Section 6(6) sets no fixed clock, requiring the Data Fiduciary to cease processing and cause its Data Processors to cease, with section 8(7) requiring erasure.
